COVID-19 Urgency Eviction Ordinance

On March 26, 2020, the City Council passed a urgency eviction ordinance which applies to residential and commercial tenants who are unable to pay their rent due to a reduction of income, loss of wages, or substantial out of pocket medical expenses as a result of the COVID-19 pandemic.  This ordinance prohibits any eviction resulting from economic losses or medical expenses related to the COVID-19 pandemic, effective immediately upon its adoption on March 26th, 2020. 

On May 29, 2020, the Governor issued Executive Order N-66-20 which, among other things, authorizes local governments to continue regulating evictions by an additional 60 days.  

On June 30, 2020, the Governor issued Executive Order EO N-71-20, which among other things, extends the authorization for local governments to halt evictions for renters impacted by COVID through September 30.

The EO extends authorization (originally granted in a March EO and extended in May) for local governments to halt evictions for renters specifically impacted by COVID-19 and the government response to it through September 30, 2020.  Any provision of state law that would preempt or otherwise restrict a local government’s police power to impose limitations on residential or commercial evictions due to COVID remains suspended.  The eviction must be due to COVID or the governmental response to COVID to receive this additional protection.

The City of Capitola passed an additional urgency ordinance to align with the Governor orders regarding evictions.  Evictions have now been extended through September 30th at the state level, and therefore within Capitola.
