Outdoor Dining Lottery 

Capitola’s outdoor dining program is in effect.  The Lottery for the 25 street parking spaces was held on August 16, 2022.  19 of the 25 spaces were assigned.  A second lottery for the remaining spaces will be held in February of 2023.

Prototype Street Dining Deck

Restaurants may opt to utilize the City's approved prototype street dining deck design.  The prototype design was approved by Planning Commission on July 21, 2022 and amended on June 1, 2023.  A building permit is and encroachment permit for the prototype design can be approved administratively by staff (no hearing required).

Revocable Encroachment Permit

All participating restaurants must complete a revocable encroachment permit prior to building permit issuance.

Note: Businesses which have been selected for lottery and have submitted all required permit applications and fees will be permitted to keep their temporary outdoor dining in place while their permits are under review, provided they are diligently working towards completing their outdoor dining deck. Once a building permit is issued, the business will be given 30 days to remove the temporary setup.
